An uncontested divorce has the same legal effect as a regular divorce. The only differences is that the parties agree on many of the issue upfront. These issues can include custody of the children, assignment of debt, and possession of the house. Instead of going to court they agree what should happen when the parties’ divorce is final. This allows the parties to be in control of the divorce instead of the judge. In an uncontested divorce it is as simple as the parties sitting down, figuring out the needs of everyone involved and filling out and filing the appropriate documents with the court. These forms include:

  • Petition for dissolution of marriage
  • Entry of appearance
  • Mandatory case disclosure
  • Divorce decree

This type of divorce is usually a more effective way to divided assets and usually allows the divorce proceeding to happen in a more timely fashion. There is also less animosity and allows the children and other family members to not have to choose sides in an already difficult time. It is also effective in deciding the custody and visitation of children, allowing the parents to make a schedule that fits their life style as opposed to having a judge assign a plan.
